    General Information
    Council may consider withdrawing an infringement in the following circumstances:

    • You were issued a Traffic Infringement Notice, but at the time of offence your vehicle had broken down and you were unable to move it.
    • You were issued a Traffic Infringement Notice, but at the time of offence you were not the driver of the vehicle.
    • A medical emergency occurred.
    • The Infringement was issued in error.
    • Regulatory signs had been removed or damaged.
    • You were issued a Traffic Infringement Notice for parking in a disabled zone, but you are able to provide a valid permit to Council.
    • You were issued a fine for a dog you were not responsible for at the time of offence.
    • Extenuating circumstances have been demonstrated to Council.

    Circumstances which do not meet the requirements for withdrawal of an Infringement may include:
    • Being unaware of the law, not seeing or misreading the regulatory signs.
    • Parking or stopping in a restricted zone without the appropriate permit.
    • Disagreeing with the principle of the law.
    • Not leaving the area to which a permissive parking sign applies – contravention of Rule 369.
    • Forgetting to take a bag to clean up after a dog; or leaving a filled bag on the ground (even if intended to collect later).
    • Being unaware of the dog regulations in an unfamiliar area.
    • Taking a dog onto Council’s beaches when not permitted.
    • Continued breaches of Local by-laws or State Legislation.

    If you have received a fine from Council don’t ignore it – Don’t let it cost you more. Your options for dealing with an infringement notice are:
    • Pay the infringement in full;
    • Apply in writing to the Chief Executive Officer of Clarence City Council at PO Box 96, Rosny Park 7018 for the withdrawal of this Infringement Notice;
    • Apply in writing to the Chief Executive Officer to vary the payment conditions; or
    • Lodge a Notice of Election for a court hearing.

    If, after 28 days, you have not taken any of the actions above, you will be taken to be convicted of the offence and the monetary penalty will be referred to a debt collection agency.
    After referral of an infringement notice, additional costs will be added to the unpaid infringement amount. Failing to pay will result in the issuing of an enforcement order. This will increase the monetary penalty and may lead to further enforcement actions being taken.
    Further, if you do not comply with the conditions of an enforcement order, sanctions will be imposed which will increase the amount that you owe.
